The terms and conditions as set out herein (“Terms”) constitute an agreement between S Fabs, located in Erode, Tamil Nadu (“we”, “us” or “our”), which operates the website www.sfabs.in and any person who accesses or uses the platform (“you” or “your”). By using the S Fabs Platform, you expressly agree to be bound by these Terms.

1. General Usage Terms

Platform Purpose: The S Fabs Platform serves as a forum to enable you to discover, select, and buy running fabrics and apparel at indicated prices.
Electronic Record: This document is an electronic record under the Information Technology Act, 2000, and does not require physical or digital signatures.
Eligibility: By accepting this Agreement, you affirm that you are 18 years of age or above. Minors may only use the platform under the supervision of a parent or legal guardian.
Account Responsibility: Registration may require mobile OTP verification. you are solely responsible for maintaining the confidentiality of your login credentials and for all actions undertaken through your account.

2. Communication Policy

Consent: By accepting these terms, you explicitly consent to receive news, updates, and promotional communications via SMS, call, or email from S Fabs, even if your number is registered under DND/NCPR.
Opt-Out: You may unsubscribe from marketing communications at any time by following the instructions provided in those messages.

3. Disclaimers and Warranties

Information Accuracy: While we strive for accuracy, we do not guarantee the completeness of information on the platform. Use of the platform is at your own risk.
Visual Representation: We provide photographs and images of fabrics. However, we disclaim any guarantee of the exactness of visual representations compared to the actual Product ultimately delivered.
Pricing: Prices are inclusive of applicable taxes at checkout but are subject to change due to external factors.
"As Is" Basis: The Services and Products are provided on an "as is" and "where-is" basis without any warranties of merchantability or fitness for a particular purpose.

4. User Restrictions

You are prohibited from:

Modifying or deleting content, including pricing or sales information.
Uploading viruses or malicious code that may disrupt the Services.

5. Terms of Sale

Contract: Placement of an order is an offer to buy. A contract is formed only when you receive a shipment confirmation.
No Returns/Cancellations: Once an order is placed, it is not open for returns or cancellations.
Personal Use: You confirm that Products are purchased for internal/personal use and not for re-sale or business purposes.
Availability: All orders are subject to product availability. We will inform you if a Product is out of stock after an order is processed.

These Terms are governed by the laws of India. Any disputes arising in relation to S Fabs or www.sfabs.in shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu.
